Accusations held against Rémy Couture

Under the article 163. 1 (a) (b) Every one commits an offense who

(a) makes, prints, publishes, distributes, circulates, or has in his possession for the purpose of publication, distribution or circulation any obscene written matter, picture, model, phonograph record or other thing whatever; or
(b) makes, prints, publishes, distributes, sells or has in his possession for the purposes of publication, distribution or circulation a crime comic. "Crime comics" are stated to be books that glorify criminal activities and have at least one depiction of such criminal actions of the book's text.

What are they trying to prove here?

To convince the jury that Mr Couture's art is a ''representation of induced sexual content'' – which means without any artistic value, or content.

The content of Remy Couture's work was the life and the journal of a fictive character of a serial killer. Remy created and produced a series of short movies and a few photoshoots along with the same thematic, all fictional work with special effects techniques. The content was mostly inspired from old horror movies and suspense thrillers.

Has there been such a case in Canadian history so far?

No. Never in Canadian history has a case relating to artistic content has existence. This will be a jurisprudence case, and the first in Canadian history.

The main objective of the defense will be to prove to the jury that mr. Couture's work is strictly artistic and creative and without malice intent.

Where does all of the Crown's expenses, of the party of the prosecutors, the party accusing mr. Remy Couture actually come from?

NO.

How much will it cost for Remy to defend his rights of freedom of expression?

All fees are estimated to cost up above 25,000 CAN$.

How much will it cost for the gouvernment(the Crown) to prosecute these allegations against Rémy Couture?

Coming from Canadian taxpayer's money, the estimated costs are up to 1 million CAN$.

What will happen to Rémy Couture if he is found guilty as charged?

He can be charged with emprisonement that can last up to 2 years. In fact if the Crown decides to make Remy Couture's case am exemplary case, this means that the verdict will be exemplary as well. Remy Couture will have a criminal record that can ruin his carreer, and his future.

How will Remy Couture's case affect the Artistic Industry, if he loses?

It is imperative to understand that ALL artistic domains shall be affected, as the article 163 states :

(1) Every one commits an offense who

(a) makes, prints, publishes, distributes, circulates, or has in his possession for the purpose of publication, distribution or circulation any obscene written matter, picture, model, phonograph record or other thing whatever; or
(b) makes, prints, publishes, distributes, sells or has in his possession for the purposes of publication, distribution or circulation a crime comic.

Mr. Rémy Couture used the World Wide Web as a platform to broadcast his work. As the law mentioned above, any kind of publication includes all types of media in all forms.

Is the movie industry exluded from Article 163?

NO. If we apply article 163 as a criminal offense, the entire movie industry should feel concerned.

However, the movie industry generates massive amounts of capital gain, in comparison with internet broadcasting wich usually does not generate any real capital gain.

THE WHOLE ARTISTIC INDUSTRY AND COMMUNITY WILL BE AFFECTED. Writers, painters, photographers, comic book drawers, movie producers, everyone will be affected in their freedom of expression.
